1. Services Provided

MyCaseCleared offers two tiers of service:

• Case Evaluation ($15): A criminal background check and automated eligibility analysis based on Colorado statutes.
• Full Service ($199): Document preparation, court filing assistance, and guidance through the expungement process.

Our automated eligibility analysis is based on publicly available information and general statutory requirements. It is not a substitute for legal advice and may not account for all factors that could affect your case.

2. No Guarantees of Outcome

We cannot and do not guarantee any specific outcome or result. Court decisions are made by judges based on the specific facts and circumstances of each case. While we strive to provide accurate information and properly prepared documents, the final decision rests with the court.

Factors beyond our control that may affect your case include:

• Court discretion and individual judge decisions
• Objections from prosecutors or other parties
• Changes in law or legal interpretation
• Accuracy and completeness of public records
• Undisclosed information or circumstances

3. Refund Policy

Evaluation Service ($15): No refunds after the background check has been completed and results delivered.

Full Service ($199): Refunds are available only if:

• We determine we cannot proceed with your case before any work begins
• We make an error in filing that cannot be corrected

No refunds are provided for:

• Court denials or unfavorable outcomes
• Cases where documents were properly prepared and filed
• Situations where you change your mind after work has begun
• Incomplete or inaccurate information provided by you

4. Your Responsibilities

You agree to:

• Provide accurate and complete information
• Review all documents before filing
• Respond promptly to requests for additional information
• Attend any required court hearings
• Comply with all court orders and requirements
• Notify us immediately of any changes to your contact information

5. Background Checks and FCRA Compliance

By using our service, you authorize us to obtain a consumer report (background check) about you for the purpose of evaluating your eligibility for expungement or record sealing.

You have certain rights under the Fair Credit Reporting Act (FCRA), including:

• The right to receive a copy of your report
• The right to dispute inaccurate information
• The right to know who has accessed your report

6. Privacy and Data Security

We take your privacy seriously and use industry-standard encryption to protect your personal information. However, no method of transmission over the internet is 100% secure. By using our service, you acknowledge and accept these inherent risks.

We will not share your information with third parties except:

• Background check providers for the purpose of obtaining your report
• Courts and government agencies as required for filing
• As required by law or legal process

7. Limitation of Liability

To the maximum extent permitted by law, MyCaseCleared shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from:

• Your use or inability to use our service
• Any court decision or legal outcome
• Errors or omissions in our service
• Unauthorized access to or alteration of your data

Our total liability to you for any claims arising from our service shall not exceed the amount you paid for that service.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

9. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our service after changes constitutes acceptance of the modified terms.
